Faculty Perks Terms of Use

Welcome to Faculty Perks. These Terms of Use ("Terms") govern your access to and use of FacultyPerks.com and related services provided by Faculty Perks, LLC ("Faculty Perks," "we," "us," or "our").

By accessing or using Faculty Perks, creating an account, or claiming or redeeming an offer, you agree to these Terms.

1. About Faculty Perks

Faculty Perks connects eligible faculty, educators, school employees, and other qualifying users with discounts, promotions, special offers, and benefits provided by participating businesses.

Faculty Perks does not generally provide the products or services promoted through these offers. Participating businesses are independent third parties responsible for their products, services, pricing, customer service, and fulfillment of their offers.

2. Eligibility

Faculty Perks is intended for eligible faculty, educators, school employees, and other individuals who meet eligibility requirements established by Faculty Perks.

Eligibility is generally verified through a valid school-issued or work email address associated with an eligible educational institution.

You agree to provide accurate and truthful information regarding your identity, employment, school affiliation, and eligibility.

Faculty Perks reserves the right to establish, modify, or verify eligibility requirements and may suspend or terminate access if we reasonably believe a user is not eligible or has provided false or misleading information.

3. Accounts

Certain Faculty Perks features require an account.

You are responsible for maintaining accurate account information and protecting your login credentials.

Accounts are intended for individual use. You may not sell, transfer, share, or provide your account to another person for the purpose of allowing that person to access offers for which they are not eligible.

4. Offers and Discounts

Participating businesses establish the terms of their offers, including discount amounts, eligible products and services, participating locations, expiration dates, exclusions, redemption requirements, and other restrictions.

Offers may be modified, suspended, or withdrawn at any time.

Unless specifically stated otherwise, offers may not be combined with other discounts, coupons, or promotions.

Faculty Perks makes reasonable efforts to present accurate offer information but does not guarantee that every offer will always be available, accurate, or accepted by a participating business.

If a discrepancy arises between an offer displayed on Faculty Perks and information provided by a participating business, Faculty Perks may attempt to help resolve the issue but does not guarantee fulfillment of the offer.

5. Participating Businesses

Participating businesses are independent businesses and are not employees, agents, partners, or representatives of Faculty Perks.

Unless expressly stated otherwise, the appearance of a business or offer on Faculty Perks does not constitute an endorsement or guarantee by Faculty Perks.

Faculty Perks is not responsible for the quality, safety, legality, availability, pricing, customer service, or performance of products or services provided by participating businesses.

Purchases and transactions take place directly between the user and the participating business.

6. Offer Redemption

Users may be required to present their Faculty Perks account, digital offer, redemption screen, code, school affiliation, or other reasonable proof of eligibility when redeeming an offer.

Offers are intended for eligible Faculty Perks members and, unless otherwise stated, are for personal use only.

Users may not copy, sell, distribute, publish, or commercially exploit Faculty Perks offers, redemption codes, or membership credentials.

Faculty Perks may implement reasonable measures to prevent fraudulent or abusive use of offers.

7. Business Participation

Participating businesses may pay Faculty Perks fees to list or promote offers, receive enhanced placement, or participate in other Faculty Perks services.

Payment or participation does not guarantee a particular number of views, claims, redemptions, customers, sales, revenue, or other results unless expressly agreed to in writing.

Participating businesses are responsible for ensuring that their offers, advertisements, pricing, products, services, and redemption practices comply with applicable laws and accurately represent what they are offering Faculty Perks members.

8. Communications

By creating an account, you agree that Faculty Perks may send you communications necessary to operate your account, including verification, security, account, and service-related messages.

Where permitted by law, Faculty Perks may also send information about new offers, promotions, participating businesses, and Faculty Perks news.

You may unsubscribe from promotional emails using the unsubscribe link included in those communications.

9. Acceptable Use

You may not use Faculty Perks to:

• misrepresent your identity, employment, or eligibility;
• fraudulently obtain or redeem offers;
• share restricted membership credentials with unauthorized individuals;
• circumvent eligibility or redemption controls;
• scrape, reproduce, copy, or systematically collect Faculty Perks content without permission;
• interfere with the operation or security of Faculty Perks;
• gain unauthorized access to accounts, databases, or systems;
• use automated systems in a manner that places an unreasonable burden on our services; or
• violate applicable law.

10. Intellectual Property

The Faculty Perks name, logo, website design, software, graphics, text, compilations, and other proprietary materials are owned by Faculty Perks, LLC or its licensors and are protected by applicable intellectual-property laws.

Participating businesses retain ownership of their respective trademarks, logos, photographs, and other proprietary materials.

11. Content Submitted to Faculty Perks

If you submit content to Faculty Perks, including business information, offers, photographs, logos, descriptions, suggestions, or other materials, you represent that you have the right to provide that content.

You grant Faculty Perks a non-exclusive, worldwide, royalty-free license to use, reproduce, display, format, distribute, and promote that content as reasonably necessary to operate and promote Faculty Perks and the applicable business or offer.

12. Service Availability

Faculty Perks may modify, suspend, restrict, or discontinue any part of the service at any time.

We do not guarantee uninterrupted or error-free access to Faculty Perks.

13. Disclaimer of Warranties

FACULTY PERKS AND ITS SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS TO THE MAXIMUM EXTENT PERMITTED BY LAW.

FACULTY PERKS DOES NOT GUARANTEE THE AVAILABILITY, ACCURACY, QUALITY, VALUE, SAFETY, OR FULFILLMENT OF ANY THIRD-PARTY OFFER, PRODUCT, OR SERVICE.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FACULTY PERKS, LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, AFFILIATES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM THE USE OF FACULTY PERKS OR DEALINGS WITH A PARTICIPATING BUSINESS.

FACULTY PERKS IS NOT RESPONSIBLE FOR INJURY, LOSS, DAMAGE, OR DISPUTES ARISING FROM PRODUCTS OR SERVICES PURCHASED FROM OR PROVIDED BY PARTICIPATING BUSINESSES.

Nothing in these Terms excludes liability that cannot legally be excluded.

15. Termination

Faculty Perks may suspend or terminate an account or access to the service when reasonably necessary to address fraud, abuse, security concerns, violations of these Terms, or conduct harmful to Faculty Perks, participating businesses, or other users.

You may stop using Faculty Perks at any time.

16. Children's Use

Faculty Perks is designed for adult faculty and school employees and is not intended for children under 13.

We do not knowingly collect personal information from children under 13.

17. Privacy

Your use of Faculty Perks is subject to our Privacy Policy, which describes how Faculty Perks collects, uses, and discloses personal information.

18. Changes to These Terms

Faculty Perks may update these Terms periodically.

When material changes are made, we will update the "Last Updated" date and provide additional notice when appropriate.

19. Governing Law

These Terms are governed by the laws of the State of South Carolina, without regard to its conflict-of-law principles.

To the extent permitted by applicable law, disputes relating to Faculty Perks or these Terms will be brought in an appropriate state or federal court located in South Carolina.
